Sales Terms and Conditions

These terms and conditions of sale (“Terms of Sale”) regulate your purchase of the products we promote and sell (“Products”) on this website (“Site”) and the shipping of these Products. When you Purchase Products via this Site, we ask you to confirm your acceptance of these Terms of Sale. If you accept these Terms of Sale a contract is formed between you and us. So, it is important that you read these Terms of Sale carefully before placing an order for Products on this Site ("Order").

We are the trader of the Products. This means that we are responsible for selling the Products to consumers. For each country a different company is responsible for selling the Products. To know the company which is responsible in the country which you select for delivery, please see a full list here. If you have already made a purchase, you can also verify the company specified on your payment receipt. We can be contacted as indicated in our Contact Us page, managed by our Customer Service.

We do our best to ensure that the information about Products is accurate and up to date. However, we do not guarantee that there will be no errors in the description and/or pricing of the Products, or that Products will always be available if you wish to place an Order to purchase them.

Also, the colours you see on your screen may depend on your computer system and settings, so we cannot guarantee that your computer will accurately display such colours.

We reserve the right to modify the information about Products displayed on our Site, including as regards prices, description and availability. However, such changes will not affect Orders for which you have already received an Order Receipt email (see below).

However, we do reserve the right to cancel any Order and refuse, reject or unwind any transaction from a manifest error in pricing, product description or other information displayed on the Site, including where such error is obvious and could reasonably have been recognised by a customer as incorrect. In such circumstances, our only obligation shall be to refund any sums paid in respect of the affected Order.

We describe here all the steps necessary to make a purchase (in legal terms, to conclude a purchase contract) on our Site.

You will receive a copy of the purchase contract at the end of the process. The purchase contract will also be available – but not modifiable – to us.

To complete a purchase, you first have to place an Order for Products. Then, this Order has to be accepted by us.

To place an Order you must be 18 years of age or over. To place an Order you will have to select the Products on the Site, select your preferred shipping method and, if you like, other optional services, and finally click on the “BUY NOW” button. We will not accept Orders placed in any way other than as detailed above.

When you place the Order through the Site you will receive an automated email confirming receipt of your Order (“Order Confirmation Email”). The Order Confirmation email contains full details of your Order (such as Order No., information on Products, prices, your shipping address, delivery costs and other). Please note that the Order Confirmation email is NOT yet an acceptance of your Order.

We usually collect payment for an Order upon confirmation of the shipment of the relevant Products (see Step 4 below).

However, if you prefer and select one of our APM entailing an upfront collection of the payment, we will collect payment upon Order Confirmation (see 2nd step above). See our Payment Terms for more details.

When your Order is accepted by us, we send you an email confirming that all, or part, of the Products have been shipped ("Shipping Confirmation email").

Once you receive the Shipping Confirmation email, your Order has been finally accepted by us and the purchase contract between you and us is concluded in relation to the Products actually shipped. Such a contract is composed by: your Order; our Order Confirmation and Shipping Confirmation emails; the then current Terms of Sale. No other terms and conditions shall apply.

The Shipping Confirmation email will contain an unmodifiable copy of the version of the Terms of Sale applicable at the time the purchase contract is concluded, for your future reference.

We will make reasonable efforts to ensure that the information about the Products are always accurate. However, when you place an Order, it can happen that certain Products may be out of stock.

If the Order covers multiple Products, then your contract will be concluded only with respect to those Products that are expressly listed in the Shipping Confirmation email. The foregoing will apply even if, based on the type of payment you selected, you pay (or direct the payment of) the price before the contract is concluded. If, in that case, the contract is still not concluded for whatever reason, then we shall notify you thereof via email (if there is a partial contractual acceptance, then via the Shipping Confirmation email for the deliverable Products) and shall refund the advance payment without undue delay.

When you place an Order, it can happen that we do some checks before fulfilling your Order. Such checks may include verification of your address or checking for fraud. Suspected fraud on the Site will be investigated and if necessary prosecuted.

While we do our best to always accept Orders, we could however refuse an Order in certain cases, for example if:

• you provide us with incomplete, incorrect or fraudulent information regarding your identity, age, payment details, billing information, shipping address;
• we discover that there was an error on our Site relating to the Products you ordered, for example as regards the price or description displayed;
• the Products you ordered are unfortunately out of stock or no longer available;
• we have reasonable grounds to believe that you intend to resell the Products. The Site is solely intended for us to sell our products direct to end consumers. This means that purchase of products for resale is strictly prohibited. Besides not accepting your Order, we also have the right to take any other action against you, including, but not limited to, restriction to sell to you or suspension or closure of your account.

If we cannot accept your Order we will contact you by email as soon as possible but in any case no later than 30 days from the date of your Order. If we cannot accept your Order because the Products are no longer available, or because of an error in the price and/or other information on our Site, we will refund you any money you may have already been charged for such Products.

In case you have selected an APM, we may exceptionally have already collected your payment when we discover that the Products might be unavailable. In such a case we will immediately contact you and issue a full refund.

The purchase prices displayed on the Site are inclusive of Value-Added Tax (VAT), as applicable. Shipping rates will be applied per Order and they depend on the country where your order is being delivered to.

Prices are quoted in the local currency for your country.

The total price specified in the final check out screen includes tax and shipping costs. This price will be recorded in the Order Confirmation.

We offer a range of delivery options, among which you can choose the one that best suits your personal needs. Specific terms and conditions, and different delivery charges, may apply to the various delivery options. Please find exhaustive details in our Delivery Terms.

You can track shipment of your Products by clicking on the "Track My Order" link in the Shipping Confirmation email. Please note such link will direct you to the carrier’s website, which is not controlled by us.

We hope you are delighted with your purchase from us, however we understand if you wish to return any or all of the Products. You can return Products if you are not satisfied or you just change your mind within 30 days of receipt (right of withdrawal).

Also, you can return faulty products within 2 years or the longer period that may be set forth by your local law (legal guarantee for consumer goods). Find out more about your legal warranty rights here.

If you experienced problems or want to make a complaint regarding a Product or a purchase made on this Site, or if you simply need after-sale assistance, you can contact us as indicated in our Contact Us page, managed by our Customer Service.

Sometimes an event outside our control can happen. Examples of such events are: strikes, lock-outs or other industrial actions by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications network.

If an event outside our control happens that affects the performance of our obligations, we will contact you as soon as reasonably possible and our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control.

If the event outside our control affects our delivery of a product to you, we will arrange a new delivery date with you after the event outside our control is over. You may cancel the Order if an event outside our control takes place and you no longer wish us to provide the product.

Our liability for damages caused by slight negligence shall, irrespective of its legal ground, be limited as follows: (i) we shall be liable up to the amount of the foreseeable damages typical for this type of contract due to a breach of material contractual obligations; (ii) we shall not be liable due to the slightly negligent breach of any other duty of care applicable.

The above limitations of liability shall not apply to any mandatory statutory liability and liability for culpably caused personal injuries. In addition, such limitations of liability shall not apply if and to the extent we have assumed a specific guarantee. The above provisions shall apply accordingly to our liability for futile expenses.

In any event, you shall take adequate measures to avert and reduce damages.

Please also note that we cannot be held responsible for delays or failure to perform our obligations under these Terms of Sale if such delay or failure is caused by any circumstances beyond our reasonable control (see Section 12 of these Terms of Sale), failures of our supplier(s), failure by you to give us correct information or to effect due payments. We will inform you of any such unforeseen events as soon as possible after they occur and we will do our best to reduce their impact on our performance as reasonably possible. Should this interruption continue beyond a period of 2 weeks, you will be entitled to cancel the Order and get a refund.

Nothing in these Terms of Sale shall affect your statutory rights as a consumer, such as your right of withdrawal or your right to a free guarantee for faulty goods as mentioned in Clause 10 above, and nothing in these Terms of Sale shall exclude or limit any liability of us that cannot be excluded or limited pursuant to the applicable law.

By placing your Order, you understand that we may store, process and use your personal data for the purposes of processing your Order. We will process your information in accordance with our Privacy Policy.

The use of this Site is subject also to our Website Terms of Use

These Terms of Sale are governed in all respects by the laws of the country of delivery applicable to your Order, without regard to its conflicts of laws rules, including, without limitation, your local legislation enacting the Consumer Rights Directive 2011/83/EU.

The competent courts of that same country shall have exclusive jurisdiction in connection with any disputes arising out of a purchase made on this Site or any Product, save for any right under mandatory provision of applicable law to establish legal proceedings in the habitual place of residence or domicile of the consumers.
